לתקנון לעבודתהממשלה קובע כך:

א)( שר המבקש להגיש הצעה להחלטה בדבר אשרור אמנה בינלאומית יעביר
אמנות
למזכיר הכנסת, שבועיים קודם, שני עותקים מנוסח האמנה בתרגומה
בינלאומיות"
לעברית ואת עיקריה, על מנת שזה יביאם לידיעת
חברי הכנסת. בתקופת
הפגרה יימנו השבועיים ממועד כינוספגרה של הכנסת.
ב)(
סעיף (א) לעיל לא יחול אם לדעת השר המגיש, בהסכמת שר החוץ ושר
המשפטים,נמנעתהמצאתעותקיהאמנהלכנסתמטעמידחיפותאוסודיות.
ג)(
לאחר העברת עותק האמנה לידיעת הכנסת כאמור לעיל ובחלוף פרק הזמן
הנקוב בסעיף (א) לעיל, תועבר למזכיר הממשלה על ידי השר המגיש הצעת
החלטה בעניין אשרור האמנה.

ננקטה בכנסת פעולה בעניין האמנה בהתאם לתקנון הכנסת, יודיע על כך
השרמגיש ההצעה בדברי ההסבר.
מזכיר הממשלה יעביר את הצעת ההחלטה בדבר אשרור האמנה לידיעת כל
חבריהממשלה, ויבקש את עמדתם בדרך שנוהגים בסעיף19
ב) בתקנון.(

ההסכם שבנדון
ייחתם בטאיפיי
, בהקדםהאפשרילאחר קבלתהאישור.
2.
מטרת ההסכם הינה לכונן מסגרת לשיתוף פעולה בילטראלי בתחומי התרבות, החינוך
והמדע, מתוך ההבנה ששת"פ תרבותי הינו נדבך חשוב ומרכזי בחיזוק היחסים בין המדינות
ובפיתוח הקשרים בין העמים.

כך למשל יכללו במסגרתו: חילופי מידע ומשלחות בתחומי האמנות, המוסיקה, המחול,
הדרמה והספרות, שיתוף פעולה בין בתי ספר לאמנות, מוזיאונים וספריות לאומיות,
השתתפות נציגי צד אחד באירועי תרבות בינלאומיים שהצד האחר מארגן או מארח, עידוד
שיתוף פעולה בתחומי השימור,וקידוםמורשת תרבותיתועוד.
4.
ההסכם ייחתם רק לאחר עם סיום ההליכים הנדרשים לצורך אישורו בכנסת ובממשלה,
ויכנסלתוקף
לאחר חתימתו עלידי שני הצדדים.

בדבר שיתוף פעולה בתחום התרבות
המשרדלכלכלהותרבות של טאיפיי בתל אביב והמשרד לכלכלה ותרבות שלישראל בטאיפיי
להלן: "הצדדים)"(
בהיותם מונחים עלידי רצונםלפתח ולחזק את מערכת היחסיםהידידותיתהקיימת בין הצדדים;
בהיותם מעוניינים לעודד שיתוףפעולה בתחום התרבות;
הסכימולאמור:
סעיף 1
הצדדיםיעודדו פיתוח שיתוףפעולה בתחוםהתרבותוכןמגעים בין עמי הצדדים.
סעיף 2
במטרהלהגבירהדדית את הידע של כל צדעל תרבותו שלהאחר, הצדדים
יעודדו את הגופים
והמוסדות המוסמכים שלהםלשתףפעולה בקיום פעילויות תרבותיות שיש בהן עניין משותף,
העשויותלכלול:
1.חילופי מידע
בתחומי האמנות, המוזיקה,המחול, הדרמהוהספרות;
2
חילופיהרצאות, תערוכות, מצגות אמנותיות, הפקות קולנוע וטלוויזיה;.
3.חילופי מבצעים
בודדים וקבוצות אמנים;
4
. .מגעים בין ארגונים מקצועיים של סופרים, אמנים, גרפיקאים, אדריכלים, מלחינים
ומוזיקאים, שחקני תיאטרון, קולנוע וטלוויזיה;
5
. שיתוף פעולה בין בתי ספרלאמנות, מוזיאוניםלאומייםוספריותלאומיות, מוסדותלאמנויות
הבמהומוסדות תרבות אחרים;
6
.השתתפות בכנסים בינלאומיים,פסטיבלים, תחרויות ומפגשים בינלאומיים בתחומים השונים
של עשייה תרבותית;
7
עידוד שיתוףפעולה וחילופי ניסיון בין המומחים של כל צדלשימוראתרים ארכיאולוגיים,.
חפצי אמנות וחומרי ארכיון;
8.הקלה על הגישה לארכיונים, ספריות של מוסדות
להשכלהגבוהה ומוסדות תרבות.

עידוד שיתוףפעולה בין מוסדותהקולנוע והטלוויזיה של הצדדים..
סעיף 3
הצדדיםיעודדו יצירת קשריםושיתוף פעולה, בהתאם למטרותהסכם זה בין מוסדות,ארגונים
או בני אדם בעלי עניין אחרים אצל הצדדים בתרבותהשטח.
סעיף 4
1
. לצורך יישום הסכםזה ניתןלהקים ועדה משותפת, בראשות ראשי המשרדים. הוועדה
המשותפת תתכנס לישיבת מליאה כל שלוש (3
) שנים או בכלעת שיהיה צורך,לסירוגין,על מנת
להסדיר אתהפרטים,לרבותהתנאיםהכספיים, של תכניות שיתוףפעולה.
2.יישום תכניות שיתוף הפעולה שהוועדההמשותפת הכינה
יוסדר ע"י נציגי הצדדים.
סעיף 5
1
. כלהפעילויותהמתבצעות בהתאםלהסכם זהיתנהלו בהתאםובכפוף לחוקים ולתקנות
הפנימיים של הצדדים.
2
. כלהפעילויותהמתבצעות בהתאםלהסכם זה יהיו כפופותלזמינותהכספים והמשאבים של
הצדדים.
סעיף 6
1.כל צדיבטיח אמצעים משפטיים להגנה על זכויות קניין רוחני של כל החומרים שהתקבלו על
בסיסהסכם זה, בהתאם לחוקים ולתקנות הפנימיים שלו.
2
. זכויות קניין רוחני שנרכשו או נוצרו כתוצאה מפעילות משותפת יוקצו בתנאים מוסכמים
הדדית שנקבעו בהסדרים נפרדיםלפני תחילת הפעילות המשותפת.
סעיף 7
צדלאיעביר כל מידע סודי שהתקבל בהתאם להסכם זה לצד שלישיכלשהוללא הסכמה מראש
ובכתב של הצד האחר.
סעיף 8
כלחילוקי דעותהנובעים מפרשנותו או מיישומו של הסכם זהייושבו בדרכי נועם בין שני
הצדדים.
סעיף 9
ניתן לשנותאת ההסכםבהסכמההדדית של הצדדים. כל שינוי ייעשה בכתב ויפעל לפי אותם
הנהלים כמו כניסתו לתוקף, כמפורט בסעיף10
.
סעיף 10
הסכם זה כפוףלאישור הצדדים בהתאם לנהליםהפנימיים שלהם. ההסכם ייכנס לתוקףבתאריך
קבלת השנייה מביןהאיגרות שבאמצעותן הצדדים מודיעים זהלזהעל השלמת הנהליםהפנימיים
שלהםהנדרשיםלכניסתולתוקף.
סעיף 11
1
הסכםזה יישאר בתוקף למשךחמש (5
) שניםויוארך אוטומטיתלתקופות נוספות שלחמש (5
)
שנים כל אחת, אלא אם כן צדיביא אותו לידי סיום במתןהודעה מוקדמת בכתב של לפחות שישה
(6
חודשים מראש לצדהאחרעל כוונתו להביא אתההסכםלידי סיום.)

.פעילויות הנמצאות בעיצומן שכבר מעובדות במסגרת הסכם זהלא יושפעו מסיומו, אלא אם כן
הצדדיםהסכימו אחרת בכתב.
ולראיההחתומים מטה, שהוסמכו לכך כדין,חתמועל הסכם זה.
נעשה בשני עותקים, כלאחד בשפות סינית, עברית ואנגלית,ולכל הנוסחים דין מקור שווה.
במקרה שלהבדלי פרשנות כלשהם, הנוסח האנגלי יגבר.

AGREEMENT
BETWEEN
THE TAIPEI ECONOMIC AND CULTURAL OFFICE IN
TEL-AVIV
AND
THE ISRAEL ECONOMIC AND CULTURAL OFFICE IN
TAIPEI
ON COOPERATION IN THE FIELD OF CULTURE
The Taipei Economic and Cultural Office in Tel-Aviv and the Israel Economic
and Cultural Office in Taipei (hereinafter referred to as the “Parties”)
Guidedbytheirdesiretodevelopandstrengthentheexistingfriendlyrelationbetween
the Parties;
Desirous to encourage cooperation in the field of culture;
HAVE agreed as follows:
Article 1
The Parties shall encourage the development of cooperation in the sphere of culture as
well as contacts between the peoples of the Parties.
Article 2
WithaviewtomutuallyenhancingeachParties’knowledgeofthecultureoftheother,
the Parties shall encourage their competent bodies and institutions to cooperate in
carryingout cultural activities of mutual interest, which mayinclude:
1. Exchangeofinformationinthefieldsoffineart,music,dance,dramaandliterature;
2. Exchange of lectures, exhibitions, artistic presentations, cinema and television
productions;
3. Exchange of individual performers and artistic groups;
4. Contactsbetweenprofessionalorganizationsofwriters,interpreters,graphicartists,
architects, composers and musicians, theatre, cinema and television actors;
5. Cooperation between schools of art, museums and libraries, performing arts
institutions and other cultural institutions;
6. Participation in international conferences, festivals, competitions and meetings in
the various fields of cultural endeavor;
7. Encouraging cooperation and exchange of experience of respective experts in
preservingarchaeological monuments, artifacts and archival materials;
8. Facilitating the access to archives, higher education institutions libraries and
cultural institutions.
9. Encourage cooperation between cinema and television institutions of the Parties.
Article 3
The Parties shall encourage the establishment of contacts and cooperation, in
compliance with the purposes of this Agreement between other interested institutions,
organizations or persons in the Parties in the field culture.
Article 4
1. For the purpose of implementation of this Agreement, a Joint Committee may be
established, headed by the Heads of Offices. The Joint Committee shall meet for
plenarysessioneverythree(3) yearsorwhenevernecessary,alternately,inorderto
settle the details, includingthe financial terms, of programs of Cooperation.
2. The implementation of the Programs of Cooperation worked out by the Joint
Committee shall be arranged bythe Parties representatives.
Article 5
1. All activities undertaken pursuant to this Agreement shall be taken in accordance
with and subject to the domestic laws and regulations of the Parties.
2. All activities undertaken pursuant to this Agreement shall be subject to the Parties'
availabilityof funds and resources.
Article 6
1. EachPartyshallensurelegalmeansfortheprotectionofintellectualpropertyrights
of all materials obtained on the basis of this Agreement, in accordance with its
domestic laws and regulations.
2. Intellectual property rights acquired or created as a result of joint activity will be
allocated by mutually agreed conditions set out in separate arrangements prior to
commencingthe joint activity.
Article 7
No Party shall transmit any confidential information obtained in pursuance of this
Agreement to anythird Partywithout prior written consent of the other Party.
Article 8
Any differences arising out of the interpretation or the implementation of this
Agreement shall be settled amicablybetween the Parties .
Article 9
The Agreement may be modified by mutual consent of the Parties. Any modification
shall be made in writing and follow the same procedures as its entering into force, as
specified in Article 10.
Article 10
This Agreement is subject to Parties' approval under their respective internal
procedures.TheAgreementshallenterintoforceonthedateofthereceiptofthesecond
of Notes by which the Parties notify each other of the completion of their internal
procedures required for its entryinto force.
Article 11
1. This Agreement shall remain in force for five (5) years and shall automatically
be extended for additional periods of five (5) years each, unless terminated by
either Party giving at least six (6) months prior notice, in writing, to the other
Party of its intention to terminate the Agreement.
2. Ongoingactivities alreadyprocessed under this Agreement will not be affected
byits termination, unless agreed otherwise in writing between the Parties.
In witness whereof, the undersigned, being duly authorized thereto, have signed this
Agreement.
Done in duplicate, each in the Chinese, Hebrew and English languages, all texts being
equally authentic. In case of any divergence of interpretation, the English text shall
prevail.
